  1. Trademarks<\/strong> (preliminary Search, Filings and Registrations, Renewals, Modifications (CPA change of proprietor’s address\/ CPN Change of proprietor’s name), Recordal of Assignment and Merger, License Deeds, Disputes, Opposition Procedure)\n

    A Trademark is a “sign” for distinguishing precisely the products and\/or services of one undertaking from those of its competitors. The sign can be a Word, a name, a slogan, a logo, a design, etc. or a combination of these elements. In filing its brand in the DRC, the applicant obtains a monopoly of exploitation throughout Congolese territory for 10 years, renewable indefinitely. A trademark is legally protected only when it is filed and registered.<\/li>\n

  2. \"Congomark,Patents<\/strong> (Search, Confidentiality Convention, Filings, Annuities payment, Modifications, Registrations, License\/Assignment Deeds, Technological Transfer, Disputes)\n

    The patent protects an invention or innovation, which is a product or a process that provides a technical solution to a given problem. The invention for which a patent may be obtained must be new, involve an inventive step and be industrially applicable.<\/p>\n

    The filing of a patent allows its holder to benefit from a monopoly to operate throughout the territory covered by the patent for a period of 20 years from date of filing. The owner of the patent thus has an exclusive right, opposable to all, which allows him to prohibit any use, manufacture, import, etc., of the invention performed without his permission, to take advantage of its invention in different forms (direct exploitation, assignment of the patent, license agreements) and to pursue the counterfeiters.<\/li>\n

  3. Industrial Models and Designs<\/strong> (Search, Filings, Renewals, Modifications, Registrations, License\/ Assignment Deeds, Disputes)\n

    A Model or a Design protects the appearance of a product or part of a product that gives, in particular, the characteristics of its lines, contours, colours, shape, texture or materials used. It is a “drawing”, if it takes the form of two-dimensional graphics and a “model” if the graphics characterize a three dimensional object.<\/p>\n

    By filing a drawing or a model in the DRC, the applicant obtained a monopoly of exploitation throughout the Congolese territory for a period of five years which may be extended for 5 years each, up to a maximum period of 25 years.<\/li>\n

  4. Domain Names<\/strong>\n

    \tThe domain name is the central part of the Internet address that is typed into the browser, which identifies a website. This address is composed of three elements the prefix (http \/ \/ www), the domain name (chosen by the Holder may be a trademark, company name, family name) and the suffix .com, .net .cd, Commonly called “extension”.<\/p>\n

    \tRegister a domain name allows you, as for trademarks, to acquire a right on the name. This is the rule of “first come, first served” which governs the registration system. By reserving your domain quickly you protect its use by another. A domain name is registered for a variable period according to the extensions.<\/li>\n

  5. \"Congomark,Copyrights<\/strong>\n

    \tAll creative works are protected by copyright, merely because they are created, without compliance with any formality. To be protected by the copyright work must be original and be materialized (Since the work is the “fruit of the creation of the author”, it is original).<\/p>\n

    \tIt is, however, recommended to deposit a work to acquire proof of the date of creation and to benefit from a presumption of ownership. The mention of copyright in the work is not mandatory in Congolese law but is recommended.<\/li>\n<\/ol>\n<\/td>\n

  1. Marques<\/strong> (recherche d\u2019ant\u00e9riorit\u00e9s, d\u00e9p\u00f4ts, oppositions, surveillances, renouvellements, modifications, inscriptions, contrats de licences\/cessions, litiges…)\n

    La marque est un \u00ab signe \u00bb permettant de distinguer pr\u00e9cis\u00e9ment les produits et\/ou les services d’une entreprise de ceux de ses concurrents. Le signe peut \u00eatre un mot, un nom, un slogan, un logo, un dessin, etc. ou la combinaison de ces diff\u00e9rents \u00e9l\u00e9ments. En d\u00e9posant sa marque en RDC, le d\u00e9posant obtient un monopole d’exploitation sur tout le territoire congolais pour 10 ans, renouvelable ind\u00e9finiment. Une marque n\u2019est prot\u00e9g\u00e9e juridiquement que lorsqu\u2019elle est d\u00e9pos\u00e9e puis enregistr\u00e9e.<\/li>\n

  2. Brevets d\u2019invention<\/strong> (recherches, contrats de confidentialit\u00e9, d\u00e9p\u00f4ts, paiement des annuit\u00e9s, modifications, inscriptions, contrats de licences\/cessions, transfert de technologie, litiges…)\n

    Le brevet prot\u00e8ge une invention ou innovation technique, c’est-\u00e0-dire un produit ou un proc\u00e9d\u00e9 qui apporte une solution technique \u00e0 un probl\u00e8me donn\u00e9.<\/p>\n

    \tL’invention pour laquelle un brevet pourra \u00eatre obtenu doit \u00eatre nouvelle, impliquer une activit\u00e9 inventive et \u00eatre susceptible d’application industrielle. Le d\u00e9p\u00f4t d\u2019un brevet permet \u00e0 son titulaire de b\u00e9n\u00e9ficier d\u2019un monopole d\u2019exploitation sur tout le territoire couvert par le brevet pendant une dur\u00e9e 20 ans \u00e0 compter du d\u00e9p\u00f4t en RDC. Le titulaire du brevet dispose ainsi d\u2019un droit exclusif, opposable \u00e0 tous, qui lui permet d\u2019interdire toute utilisation, fabrication, importation, etc., de l’invention effectu\u00e9e sans son autorisation, de tirer profit de son invention sous diff\u00e9rentes formes (exploitation directe, cession du brevet, accords de licence) et de poursuivre les contrefacteurs.<\/li>\n

  3. Mod\u00e8les et dessins industriels<\/strong> (recherches, d\u00e9p\u00f4ts, renouvellements, modifications, inscriptions, contrats de licences\/cessions, litiges…)\n

    Un dessin ou mod\u00e8le prot\u00e8ge l’apparence d’un produit ou d’une partie de produit que lui conf\u00e8re, en particulier, les caract\u00e9ristiques de ses lignes, ses contours, ses couleurs, sa forme, sa texture ou les mat\u00e9riaux utilis\u00e9s.<\/p>\n

    \tIl s\u2019agit d\u2019un dessin, si il se mat\u00e9rialise par des \u00e9l\u00e9ments graphiques en deux dimensions et d\u2019un \u00ab mod\u00e8le \u00bb si les \u00e9l\u00e9ments graphiques le caract\u00e9risant comportent trois dimensions. En d\u00e9posant un dessin ou un mod\u00e8le en RDC, le d\u00e9posant obtient un monopole d’exploitation sur tout le territoire congolais pour une dur\u00e9e de 5 ans qui peut \u00eatre prolong\u00e9e par tranche de 5 ans, jusqu’\u00e0 une p\u00e9riode maximale de 25 ans.<\/li>\n

  4. Noms de domaines<\/strong>\n

    Le nom de domaine est la partie centrale de l’adresse Internet qui est tap\u00e9e dans le navigateur et qui permet d\u2019identifier un site internet.<\/p>\n

    \tCette adresse est compos\u00e9e de trois \u00e9l\u00e9ments: le pr\u00e9fixe (http:\/\/www), le nom de domaine (au choix du titulaire il peut s\u2019agir d\u2019une marque, du nom de la soci\u00e9t\u00e9, du nom de famille) et le suffixe .com, .net, .cd… commun\u00e9ment appel\u00e9 ‘extension’. Enregistrer un nom de domaine permet, comme pour les marques, d\u2019acqu\u00e9rir un droit sur le nom. C\u2019est la r\u00e8gle dite du \u00ab premier arriv\u00e9, premier servi \u00bb qui r\u00e9git le syst\u00e8me d\u2019enregistrement. En r\u00e9servant votre domaine rapidement vous vous prot\u00e9gez de son utilisation par un autre.<\/p>\n

    \tUn nom de domaine est enregistr\u00e9 pour une dur\u00e9e variable selon les extensions.<\/li>\n

  5. Droits d’auteur<\/strong>\n

    Toutes les \u0153uvres de l\u2019esprit sont prot\u00e9g\u00e9es par le droit d\u2019auteur, du seul fait de leur cr\u00e9ation, sans l\u2019accomplissement d\u2019aucune formalit\u00e9.<\/p>\n

    \tPour b\u00e9n\u00e9ficier de la protection par le droit d\u2019auteur l\u2019\u0153uvre doit \u00eatre mat\u00e9rialis\u00e9e et \u00eatre originale (D\u00e8s lors que l\u2019\u0153uvre est le ‘ fruit de la cr\u00e9ation de l\u2019auteur ‘, elle est originale). Il est cependant recommand\u00e9 de d\u00e9poser son \u0153uvre afin d\u2019obtenir la preuve de la date de cr\u00e9ation et b\u00e9n\u00e9ficier d\u2019une pr\u00e9somption de propri\u00e9t\u00e9. La mention des droits d\u2019auteur sur l\u2019\u0153uvre n\u2019est pas exig\u00e9e en droit congolais. Elle est cependant recommand\u00e9e. Cette mention permet d\u2019informer le public de ce que l\u2019\u0153uvre fait l\u2019objet d\u2019une protection par le droit d\u2019auteur et de conf\u00e9rer \u00e0 l\u2019\u0153uvre une protection dans les pays qui exigent une telle mention (notamment pour accorder des dommages int\u00e9r\u00eats en cas de contrefa\u00e7on).<\/li>\n<\/td>\n<\/tr>\n<\/table>\n","protected":false},"excerpt":{"rendered":"
